Lenexa, KS 66219, United States, 20th Apr 2023 – The mother of a former NCAA and an international athlete is speaking out after a lawsuit was filed against her in Johnson County District Court, by Kennyhertz Perry, LLC, a Kansas State law firm with offices in both Kansas and Missouri. After hiring Mit Winter, Kennyhertz Perry, to represent her after her son almost died on a by the firm.
Jennifer Dickinson, the mother of a former NCAA elite athlete with a signed European professional player offer in hand, collapsed on a University soccer field after weeks and weeks of experiencing ongoing signs of exhaustion, compromised breathing, and reduced motor skills. Despite these warning signs, the coaches did not offer him medical attention. Instead, they belittled him for his lack of focus and dedication while he sat on the sidelines, unable to breathe. The NCAA athlete limped off the training field and collapsed in a portable toilet. He was not given medical attention during training or the collapse. Eventually, at the urgency of the NCAA player’s physician, he was rushed to the Emergency Room for evaluation.
After this mother’s son nearly died from collapsing on a soccer field, Jennifer Dickinson searched for an experienced sports lawyer to navigate discussions with the University. The willingness of the University to settle the case supporting the mother and athlete’s need to move forward after the tragedy should have made a private settlement easy and quick. The University was on board to support the NCAA athlete’s physical recovery and his Freshman academic structure. From his bedridden state, the University agreed to create an unprecedented online program to ensure the athlete kept up his goal of maintaining his University enrollment status while his physical body recovered.
Jennifer Dickinson was surfing the internet, day after day, and one attorney, Mit Winter, stuck out. Numerous accomplishments in the Sports Law arena made him a standout year after year. Mit Winter’s name appeared to be the ‘go-to’ for legal advice, support, and advocacy for NCAA athletes. The athlete’s mother, Jennifer Dickinson, hired Mit Winter, one of KennyHertz Perry’s premier Sports Lawyers. What could go wrong if you hire one of the best Sports Law attorneys, an advocate for NCAA athletes?
Johnson County District Court documents state the case stems from an incident in which Dickinson’s son collapsed on a soccer field, resulting in life-threatening complications due to negligence. Dickinson claims that the law firm Kennyhertz Perry failed to provide the quality of legal representation advertised and promoted on their website and that this failure, billing fraud, and libel allegations when John Kennyhertz falsified conversations to opposing counsel motivated by a desire to redirect settlement funds, led to her and her families prolonged suffering and irreversible damages.
Johnson County District Court documents identify allegations that Mit Winter, KennyHertz Perry’s attorney, did not provide the Universities counsel and other decision-makers present at the mediation, Dickinson’s son’s vital offer, a FIFA Agent’s $580,000.00 signed professional player offer on mediation day, not including the signing bonus. The mediation was a bust.
Despite these allegations, the law firm filed a lawsuit in Johnson County District Court against Dickinson, claiming that she had not paid her bills and breached her contract, perhaps hoping she would back down, after the exhaustion of her son’s near death experience and long road to recovery. However, rather than backing down, Dickinson fired back with her counterclaim, alleging fraud, misrepresentation, unethical behavior, and libel.
Suppose Dickinson’s case goes to trial, as she has demanded an in-person jury trial, the Kennyhertz Perry, LLC vs. Jennifer Dickinson. That scenario will mark a significant moment in Kansas State history when a Pro se individual takes on a high-powered law firm.
Dickinson is determined to seek justice by holding the law firm’s co-founders, business manager, and attorney, Mit Shipman, accountable for its actions. In Person Jury Trial April 15th, 2024-Johnson County District Court.
